References to "you" or "your" mean the customer or person using our website or purchasing goods or services from us.

These Terms apply to orders placed through our website and, where applicable and incorporated into the transaction, orders placed with us in-store, by telephone, email, WhatsApp or other direct communication.

Nothing in these Terms affects your statutory rights as a consumer.

2. USING OUR WEBSITE

By using our website, you agree to these Terms and any other policies referred to on our website, including our Privacy Policy.

You must use our website only for lawful purposes.

Where you create an account or provide personal information, you are responsible for ensuring that the information you provide is accurate and up to date.

If you create login details or a password, you are responsible for keeping those details confidential.

We may suspend or restrict access to our website where reasonably necessary, including for maintenance, security, technical reasons or suspected misuse.

3. OUR PRODUCTS

We specialise in jewellery including engagement rings, wedding rings, diamond jewellery, gemstones, bespoke jewellery and associated services.

We make reasonable efforts to ensure that descriptions, photographs, videos, measurements and specifications shown on our website are accurate.

However, jewellery is a physical product and its appearance may vary slightly from images displayed on a screen.

Differences may arise as a result of:

  • screen settings, lighting and photography;

  • hand finishing and manufacturing tolerances;

  • the individual characteristics of diamonds, gemstones and precious metals; and

  • natural variations within gemstones.

Minor variations of this nature do not necessarily constitute a fault where the finished product remains consistent with the agreed description and specification.

Nothing in this section permits us to provide goods that are materially different from what was agreed with you.

4. BESPOKE, MADE-TO-ORDER AND PERSONALISED JEWELLERY

A significant proportion of the jewellery we supply is made, manufactured, altered or sourced specifically for an individual customer.

This may include:

  • bespoke jewellery;

  • engagement rings manufactured to order;

  • wedding rings manufactured to a particular size, width or specification;

  • jewellery altered to a customer's requested ring size;

  • personalised jewellery;

  • engraved jewellery;

  • jewellery manufactured around a particular diamond or gemstone;

  • jewellery made to an approved CAD or design;

  • specially sourced diamonds or gemstones where agreed as part of a bespoke order; and

  • any other item made or materially altered to your individual specification.

Where an item is genuinely made to your specifications or clearly personalised, statutory cancellation rights applicable to standard distance-sale goods may not apply.

This does not affect your statutory rights if the item is faulty, not as described or otherwise does not conform to the contract.

5. CAD DESIGNS, DRAWINGS AND BESPOKE APPROVAL

Where we provide a CAD design, computer rendering, sketch, resin model, wax model or other visual representation, it is intended to show the proposed design and proportions of the jewellery.

CAD images and computer renderings are not photographs of the finished product.

The appearance of claws, settings, curves, edges, surfaces and other details may appear more pronounced in a CAD image than on the finished, hand-finished piece.

Reasonable manufacturing tolerances and minor differences resulting from casting, setting, polishing and hand finishing are normal.

Once you approve a CAD or bespoke design, we may proceed with manufacture based on that approval.

If you request material changes after approval or once manufacture has started, additional charges and additional production time may apply. We will discuss these with you before carrying out additional chargeable work.

Any CAD or design fee which has been expressly agreed with you will be treated in accordance with the terms communicated at the time of commissioning.

6. ORDERS AND CONTRACT FORMATION

Submitting an order, paying a deposit or making an enquiry does not necessarily mean that we have accepted your order.

A contract between you and us is formed when we confirm acceptance of your order or otherwise clearly agree to supply the goods or services.

We may decline an order before acceptance, including where:

  • a product, diamond or gemstone is no longer available;

  • there is an obvious pricing or description error;

  • we cannot reasonably meet the requested specification;

  • payment has not been authorised;

  • we reasonably suspect fraud or unlawful activity; or

  • we are unable to supply the item for another legitimate reason.

If we have received money for an order that we subsequently cannot accept, we will refund the relevant amount.

Please check your order confirmation carefully and tell us promptly if anything is incorrect.

7. PRICES

Prices are stated in pounds sterling unless otherwise indicated.

Prices displayed to UK consumers will include VAT where applicable unless clearly stated otherwise.

Delivery or other additional charges, where applicable, will be communicated before you become bound by the order.

Prices may change from time to time.

The price applicable to your order will normally be the price agreed when the order is accepted.

Diamonds, gemstones and precious metals are internationally traded products and supplier prices and availability may change.

A quotation does not reserve a diamond, gemstone or other item unless we have expressly confirmed that it has been reserved or ordered for you.

Quotations may be subject to an expiry period. Where an expiry period is stated, the quotation will cease to be valid after that period unless we agree otherwise.

8. PAYMENTS AND DEPOSITS

We may require a deposit before ordering materials, reserving a diamond or gemstone or beginning manufacture.

Any deposit forms part of the total purchase price.

The amount of the deposit and the remaining balance will be confirmed when the order is placed.

Unless otherwise agreed in writing, the outstanding balance must be paid before goods are released, collected or dispatched.

For bespoke, personalised or made-to-order jewellery, we may begin committing costs after an order is confirmed, including purchasing diamonds, gemstones, mounts or precious metals and beginning CAD, manufacturing, setting or workshop work.

Where you do not have a statutory right to cancel and nevertheless ask us to cancel an order, we may choose to agree to cancellation.

Where we agree to such a cancellation, we may deduct reasonable costs and losses already incurred as a result of the order. We will not retain more than is reasonably justified in the circumstances.

Nothing in this section affects any statutory cancellation or refund rights you may have.

9. CANCELLATION RIGHTS FOR ONLINE AND DISTANCE ORDERS

For standard goods purchased online, by telephone or through another distance-selling method, you may have a statutory right to cancel your contract without giving a reason.

Where that right applies, the cancellation period normally expires 14 days after the day on which you, or a person nominated by you other than the carrier, takes physical possession of the goods.

You must clearly tell us that you wish to cancel.

Following cancellation, you must return the goods to us within the period required by applicable law, normally within 14 days of telling us that you wish to cancel.

Unless the goods are faulty or we agree otherwise, you are normally responsible for the cost of returning cancelled goods.

We may withhold a refund until we have received the goods back or you provide evidence that they have been returned, where permitted by law.

Where you validly exercise a statutory cancellation right, we will refund the payments due to you in accordance with applicable law.

Where applicable, this includes the cost of our least expensive standard delivery method. Additional delivery costs resulting from your choice of an enhanced or more expensive delivery service are not necessarily refundable.

We may make a deduction where the value of returned goods has been reduced as a result of handling beyond what would reasonably be permitted when examining an item in a shop, where the law allows us to do so.

Bespoke and personalised goods

The statutory cooling-off right does not apply to goods which are made to the consumer's specifications or are clearly personalised.

Accordingly, this may apply to jewellery genuinely manufactured or altered specifically for you, including bespoke jewellery, engraved jewellery and jewellery made or materially altered to your agreed specification.

This exemption from cancellation rights does not remove your rights in relation to faulty goods or goods which are not as described.

Purchases made in our showroom

There is generally no automatic statutory right to return an item purchased in person simply because you have changed your mind.

Any discretionary exchange or return offered by us in those circumstances is additional to your statutory rights and may be subject to conditions.

10. FAULTY GOODS AND YOUR STATUTORY RIGHTS

We are required by law to supply goods which conform to the contract.

Among other requirements, goods supplied to consumers must be:

  • of satisfactory quality;

  • fit for any particular purpose made known to us where the law applies; and

  • as described.

The Consumer Rights Act 2015 provides consumers with remedies where goods fail to meet applicable statutory requirements.

Depending on the circumstances, these rights may include a short-term right to reject faulty goods and rights relating to repair, replacement, price reduction or final rejection.

These statutory rights apply independently of any commercial warranty we provide.

Nothing in these Terms seeks to exclude, limit or replace those rights.

11. DELIVERY

Any delivery dates or production times we provide are estimates unless we expressly agree in writing that a particular date is guaranteed or forms an essential term of the contract.

Bespoke jewellery involves a number of stages which may include sourcing stones, CAD production, casting, hallmarking, setting, sizing, polishing and quality control.

Occasionally delays can occur outside our reasonable control.

If a delay occurs, we will seek to keep you reasonably informed.

Nothing in these Terms limits your statutory rights concerning late delivery.

Risk during delivery

Where you are a consumer, goods remain at our risk until they come into the physical possession of you or a person identified by you to receive them.

An exception may apply where you independently commission a carrier that we did not offer as a delivery option.

We recommend inspecting delivered packages promptly and contacting us as soon as reasonably possible if a parcel appears damaged or tampered with.

12. COLLECTION FROM OUR SHOWROOM

Where an order is to be collected from our showroom, we may ask for proof of identity or order confirmation before releasing high-value jewellery.

We may refuse to release goods where we reasonably believe that doing so could expose you or us to fraud or theft.

The outstanding balance must normally be paid before collection unless otherwise agreed.

13. RING SIZING AND RESIZING

It is important that the correct ring size is provided when an order is placed.

Where you provide us with a ring size remotely, we will manufacture or alter the ring based on the size you provide.

If the supplied size is incorrect, resizing may be chargeable unless we have expressly agreed otherwise.

Where we have incorrectly manufactured a ring compared with the size agreed in the order, your statutory rights are unaffected.

Not every ring can safely be resized.

The ability to resize a ring depends on factors including its design, metal, stone setting and the extent of diamond or gemstone coverage.

For example, some full-eternity or fully set rings may not be capable of conventional resizing.

Where resizing is technically possible, alterations may have reasonable manufacturing tolerances.

We will advise you where a proposed resize may materially affect the integrity or appearance of the jewellery.

14. DIAMONDS AND GEMSTONES

We sell both natural diamonds and lab-grown diamonds.

The nature of the diamond supplied will be stated in the applicable product description, quotation, invoice, order confirmation, certificate or other sales documentation.

We take reasonable care to describe diamonds and gemstones accurately.

Where an independent grading report is supplied, grading has been carried out by the relevant independent laboratory rather than by Elegance Jewellers.

Laboratories may include organisations such as the Gemological Institute of America (GIA) or International Gemological Institute (IGI), depending on the item.

Unless expressly stated otherwise, not every individual small diamond or gemstone used within an item will have its own independent grading report.

Diamond and gemstone grading involves recognised professional assessment and grading standards. Minor differences between grading organisations or professional opinions can occur.

Natural diamonds and gemstones may contain characteristics and inclusions created by nature.

Lab-grown diamonds may also contain growth characteristics.

These characteristics do not of themselves constitute defects where the stone corresponds with its agreed description or grading.

15. JEWELLERY IS NOT SOLD AS AN INVESTMENT

We sell jewellery for personal use and enjoyment.

We do not sell diamonds, gemstones or jewellery on the basis that they are financial investments and we do not guarantee that any item will maintain or increase its value.

Retail purchase price, insurance replacement value, trade value and second-hand resale value are different concepts and may differ significantly.

The resale value of diamonds, gemstones, precious metals and finished jewellery can change over time according to market conditions and other factors.

No statement made by us should be interpreted as a guarantee of future resale value unless we expressly provide a written contractual guarantee stating otherwise.

16. CERTIFICATES AND INSURANCE VALUATIONS

Where an independent diamond or gemstone certificate forms part of an order, details will normally be stated in your order documentation.

We may also provide an insurance valuation or valuation certificate for jewellery purchased from us.

An insurance valuation is intended to provide an opinion of replacement value for insurance purposes at the relevant valuation date.

It is not a representation of the amount for which the jewellery could be sold second-hand and is not an investment valuation or guaranteed resale value.

Replacement values may change over time as diamond, gemstone, precious-metal, labour and retail replacement costs change.

Insurance companies may have their own requirements regarding how frequently valuation documents should be updated.

Where requested, we may be able to provide updated valuation documentation or revaluation services. Any applicable charge will be confirmed at the time.

You remain responsible for checking your insurer's particular requirements.

17. PRECIOUS METALS AND HALLMARKING

Precious-metal jewellery supplied by us will comply with applicable UK hallmarking requirements.

Where an item is described as being made from a particular precious metal or fineness, the description contained in the agreed order or product specification will apply.

Hallmarks are applied by authorised assay offices and may vary in size or location depending on the jewellery.

18. REPAIRS, ALTERATIONS AND OTHER SERVICES

We may provide services including repairs, resizing, stone setting, polishing, cleaning, restoration and jewellery alterations.

Services provided to consumers will be carried out with reasonable care and skill as required by law.

Where an estimate is given before full inspection or dismantling, it may sometimes be necessary to revise the estimate if additional issues become apparent.

We will seek your approval before carrying out materially additional chargeable work.

Jewellery naturally wears with use.

Claws, settings, chains, links, clasps and other components may become worn, stretched or weakened over time.

During cleaning, repair or inspection, previously hidden damage or weaknesses may become apparent.

We are not responsible for a pre-existing defect, weakness or deterioration merely because it becomes visible during a service, provided we have exercised reasonable care and skill.

We will remain responsible where loss or damage results from our failure to exercise the standard of care required by law.

Where an item has previously been repaired, altered or worked on by another jeweller, we may need to inspect it before agreeing to further work.

19. ONE-YEAR MANUFACTURING WARRANTY

Jewellery purchased directly from Elegance Jewellers is supplied with our one-year manufacturing warranty, beginning on the date the item is delivered or collected.

This is a commercial warranty provided by Tri A Trading Company Limited trading as Elegance Jewellers, 9 Greville Street, London EC1N 8SB.

The warranty covers manufacturing defects which become apparent during the warranty period.

Where our inspection confirms that an issue has arisen from a manufacturing defect, we will provide an appropriate remedy under the warranty, which will ordinarily involve repair without charge and, where repair is not appropriate, may involve replacement, remanufacture or another suitable remedy.

The warranty does not cover damage arising from:

  • normal wear and tear;

  • accidental damage;

  • misuse or neglect;

  • impact, crushing or bending;

  • loss or theft;

  • damage caused by another person or jeweller;

  • damage resulting from unauthorised modification, repair or resizing;

  • damage caused by failure to maintain worn claws or settings;

  • deterioration of plating or finishes which naturally require maintenance;

  • damage caused by exposure to unsuitable chemicals or conditions; or

  • loss of a stone where inspection shows that the loss resulted from impact, damage or normal wear rather than a manufacturing defect.

If a stone becomes loose or is lost because of a confirmed manufacturing or setting defect, this will be dealt with under the warranty as appropriate.

Where damage results from wear and tear or accidental damage rather than a manufacturing defect, we may still be able to repair the jewellery and will provide an estimate where applicable.

The warranty applies to items purchased directly from Elegance Jewellers. Warranty claims are administered through our London premises.

This warranty is in addition to your statutory rights. Your statutory rights in relation to faulty goods are not affected or limited by this warranty.

20. LIFETIME INSPECTION AND CLEANING SERVICE

For jewellery purchased directly from Elegance Jewellers, we offer complimentary routine inspection and standard cleaning for the life of the item.

This service is intended to help customers identify wear and maintenance requirements.

The complimentary service does not automatically include repair work, replacement stones, rhodium plating, extensive refinishing, resizing or replacement of worn components.

If our inspection identifies work which we recommend carrying out, we will explain the work and any applicable charge before proceeding.

Failure to have an item inspected does not remove statutory rights, although damage resulting from normal wear, impact or failure to maintain worn jewellery is not necessarily a manufacturing defect.

21. INTELLECTUAL PROPERTY

The content of our website, including our branding, photographs, videos, graphics, designs, product descriptions, text, logos and website content, belongs to us or is used by us under licence and is protected by applicable intellectual-property law.

You may use our website for your own personal and non-commercial purposes.

You must not reproduce, commercially exploit, copy, distribute or republish our content without permission except where permitted by law.

Bespoke designs, CAD files and manufacturing drawings created by or for us remain our intellectual property unless we expressly agree otherwise in writing.

Purchasing a finished piece of jewellery does not automatically transfer ownership of underlying CAD files, drawings or manufacturing designs.

22. THIRD-PARTY SERVICES AND SHOPIFY

Our website may use services supplied by third parties.

Our online store is hosted or supported by Shopify and may use third-party payment providers, delivery providers and other technology services.

Your purchase contract for jewellery from Elegance Jewellers is between you and Tri A Trading Company Limited trading as Elegance Jewellers, not Shopify.

Third-party websites and services may have their own terms and privacy policies.

We are not responsible for content on third-party websites that we do not control.

Nothing in this section excludes any liability we have under applicable law for services we choose to use in fulfilling our obligations to you.

23. PRIVACY

We take the protection of personal information seriously.

Information we collect and process is handled in accordance with our Privacy Policy and applicable data-protection law.

Our website and associated service providers, including Shopify and payment-service providers, may process personal information where necessary to operate the website, process payments and fulfil orders.

Please see our Privacy Policy for further information about how your personal information is used.

24. REVIEWS, FEEDBACK AND CUSTOMER CONTENT

If you voluntarily provide a review, testimonial, photograph or other feedback, you confirm that the material you provide is truthful to the best of your knowledge and that you have the right to provide it.

Where you separately give us permission to use customer photographs, testimonials or similar content for marketing purposes, we may use that material in accordance with the permission provided.

Nothing in these Terms prevents you from giving an honest review or exercising any legal right to make a complaint.

25. PROHIBITED USE OF OUR WEBSITE

You must not use our website:

  • for unlawful or fraudulent purposes;

  • to introduce malicious software, viruses or harmful code;

  • to attempt unauthorised access to our systems or accounts;

  • to interfere with the operation or security of our website;

  • to impersonate another person;

  • to misuse personal information;

  • to infringe our intellectual-property rights or those of another person; or

  • to conduct unauthorised automated scraping or extraction that interferes with the website or breaches applicable law.

We may restrict access where reasonably necessary to protect our business, customers or systems.

26. ERRORS, AVAILABILITY AND WEBSITE INFORMATION

We make reasonable efforts to keep our website accurate and up to date.

Occasionally a typographical error, pricing error, availability error or other mistake may occur.

If we discover an obvious error before accepting an order, we may correct it and give you the opportunity to proceed on the corrected basis.

If an error is discovered after an order is placed, your legal rights and the circumstances of the particular transaction will determine how it is handled.

We will not knowingly rely on an obvious website error in order to mislead a customer.

27. LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms excludes or restricts:

  • liability for death or personal injury caused by negligence;

  • liability for fraud or fraudulent misrepresentation;

  • your statutory rights under the Consumer Rights Act 2015;

  • our obligation to perform consumer services with reasonable care and skill; or

  • any other liability which cannot lawfully be excluded or restricted.

Where you are acting as a consumer, we are responsible for losses that are a foreseeable result of our breach of the contract or our failure to use reasonable care and skill.

We are not responsible for losses which were not reasonably foreseeable when the contract was formed, except where the law provides otherwise.

We supply our products to consumers principally for private use.

If you use products for commercial, business or resale purposes, different legal rules may apply and you should contact us before ordering if you require business-to-business terms.

28. EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for a failure or delay caused by circumstances outside our reasonable control where the law permits.

Such circumstances may include serious disruption to transportation, supplier failure outside our reasonable control, natural disasters, industrial action, war, civil disturbance, government restrictions, utility failures or other exceptional events.

Where such an event affects your order, we will take reasonable steps to minimise the effect and contact you where appropriate.

Nothing in this section removes any statutory right you have to cancel or obtain a refund where applicable.

29. CHANGES TO THESE TERMS

We may update these Terms from time to time, for example to reflect changes to our business, website or applicable law.

The Terms applying to a purchase will normally be those in force when your contract with us was formed unless a change is required by law or is expressly agreed between us.

The current version will be available on our website.

30. SEVERABILITY

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

31. WAIVER

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

Similarly, delaying enforcement of a right does not prevent us from enforcing it later.

32. ENTIRE AGREEMENT

These Terms, together with the relevant order confirmation, product specification and any policies expressly incorporated into the contract, set out the terms governing the relevant transaction.

Nothing in this section limits liability for fraud or prevents a consumer relying on information which the law treats as part of the contract.

33. GOVERNING LAW AND JURISDICTION

These Terms and contracts between you and us are governed by the laws of England and Wales.

If you are a consumer, this does not deprive you of any mandatory legal protections that apply to you because of where you live.

Nothing in this section limits any right you may have under applicable law to bring proceedings before a court with jurisdiction to hear your claim.

This may include:

  • bespoke jewellery;

  • a product, diamond or gemstone is no longer available;

  • there is an obvious pricing or description error;

  • payment has not been authorised;

Where that right applies, the cancellation period normally expires 14 days after the day on which you, or a person nominated by you other than the carrier, takes physical possession of the goods.

Following cancellation, you must return the goods to us within the period required by applicable law, normally within 14 days of telling us that you wish to cancel.

Unless the goods are faulty or we agree otherwise, you are normally responsible for the cost of returning cancelled goods.

  • of satisfactory quality;

  • fit for any particular purpose made known to us where the law applies; and

  • normal wear and tear;

  • accidental damage;

  • misuse or neglect;

  • impact, crushing or bending;

  • loss or theft;

  • damage caused by another person or jeweller;

  • damage resulting from unauthorised modification, repair or resizing;

  • damage caused by failure to maintain worn claws or settings;

  • deterioration of plating or finishes which naturally require maintenance;

  • for unlawful or fraudulent purposes;

  • to introduce malicious software, viruses or harmful code;

  • to attempt unauthorised access to our systems or accounts;

  • to interfere with the operation or security of our website;

  • to impersonate another person;

  • to misuse personal information;

  • liability for death or personal injury caused by negligence;

  • liability for fraud or fraudulent misrepresentation;

  • your statutory rights under the Consumer Rights Act 2015;
